NAVA supports the right of all performers to protect themselves from unauthorized usage through digital cloning of their voices, likenesses, and performances. NAVA understands however, that the power of protection is often in the control of the producers or clients that they work for. NAVA and it’s members desire to empower themselves by obtaining assurances from those they work for that the people and institutions they trust with their recorded performances will not break that trust by engaging in any unauthorized usage.

The companies listed below have provided those assurances.

TRAINING:

Any company which requires the signing of terms of service, will have clearly outlined terms of service or company policies, which prohibit the unauthorized use of a person’s data and sound files for the creation and/or training of Synthetic voice models created using AI and/or Machine Learning.

CONSENT:

All users of our company’s services have the right to actively consent to the use of their voice, image, name and/or likeness for the creation, training, and modeling of Synthetic voice models, digital clones, and replicas created using AI and/or Machine Learning. This includes, but is not limited to, the use of sound files, video, or other media containing a user’s biometric data.

CONTROL:

All users of our company’s services have reasonable control of the work created using their voice, image, name, and likeness.

If a synthetic voice model or digital double is created, users have reasonable control over the types of work that can be generated by their synthetic voice model, digital clone, or replica. This control may be project-specific, and the parameters of this control should be decided upon in advance.

COMPENSATION:

All users should be fairly compensated, according to a mutually agreed upon rate and rate structure if a company ever wishes to use their voice or sound files for the creation, training, and modeling of Synthetic voice models created using AI and/or Machine Learning.

Note: Some examples of industry standard rates are from SAG-AFTRA, GVAA, or other industry wide accepted rate guides applicable to the location or country you are working in.

SECURITY:

Our company agrees to use good faith efforts to prevent any files of recordings or performances stored in digital format containing a user’s voice or likeness from unauthorized access by third parties, and if such files are stored in “the cloud” Client agrees to utilize services that offer safeguards through encryption or other “up-to date” technological means from unauthorized third party access.

SOURCING:

Our company agrees that all files used for the training and creation of Synthetic voice models created using AI and/or Machine Learning will be fairly sourced, with the active consent and knowledge of the person the files are sourced from.

We have strong anti-AI values on our company. In our website’s TOS, section 4.1, we outline that AI scraping and training is prohibited on our site. Any page that has narrator vocal samples on public display is protected with a CloudFlare “Are you human?” Verification. In our service agreements and contracts when hiring narrators for an audiobook, we have multiple clauses where we, the Producer, and our audio engineers are prohibited from using the audio files for any AI or machine learning purposes. Our service agreements and contracts with our clients (authors) also prohibits the client from using our audio files or our narrators voices for any AI or machine learning.

If such termination is by Talent without cause, Talent agrees to the continued and ongoing usage of the Deliverables by Ethovox for all licenses and sub-licenses existing at the time of termination as between Ethovox and its customers in which Talent previously agreed to the use of the Deliverables.

The following rates are in effect as of the date of this Agreement and shall increase indexed to the Corporate/Educational & Non-Broadcast Contract, Category II rates: ● 1st hour: $563.00 ● Each additional ½ hour: $148.00 In addition, Developer agrees to pay the then-current rate in the Co-Ed (currently, eighteen and seventy-five hundredths percent (18.75%)) on all gross compensation as contributions to the Plans (“Plan Contribution”). Plan Contributions are due at the time the Performer(s)’s compensation is paid and shall be paid directly to the Plans. Performers shall be paid not less than the minimum applicable fees due hereunder not later than thirty (30) days after services have been rendered.

Ethovox’s agreements with clients and talent mandate that any use of its AI-generated voice models be subject to the informed consent of talent, limited to the permitted use agreed between client and talent, subject to the ongoing control by talent over usage, and that talent must be compensated according to SAG-AFTRA guidelines.

Unauthorised use of a Contacts’ data, including their audio and video media, for the creation and/or training of synthetic voice models created using artificial intelligence and/or machine learning is strictly prohibited.

https://app.mediartis.com/terms (section 3.3) : Contacts with Samples processed in the User’s Database receive an email advising them they are referenced in the User’s Contact List (referred to as Casting Database in the email). Emails contain links to secured pages on Mediartis that contain all of the Contacts personal data. The Contact has the possibility of authorising or refusing : Use of their Personal Data in order to be contacted during or after Castings Use of their Samples to organise Castings That their Personal Data be updated in all of the User databases uploaded to the Platform Contacts also have the possibility of requesting the modification, deletion and portability of their Personal Data. These requests are made via a communication zone specifically designed for this purpose on their Mediartis page, or by sending an email to personaldata@mediartis.com that is forwarded to the User. When Consent collection is automatically managed (GDPR – Automated processing), an email is sent to the Contact. In the event the Contact requests a modification or deletion of their Personal Data, the Platform automatically communicates the request to the User and proceeds with the deletion or modification of the entirety of the Contacts Personal Data within 30 of the request.

Compensation

Mediartis provides tools for studios to manage their private voice casting databases (actor data and audio/video media) and casting project management. The platform does not provide tools to manage contracts. This section is non applicable to our activities.

The features of our platform align with the European GDPR – the strictest data privacy legislation worldwide. Our services simplify data security and data privacy legal obligations for studios, agencies, agents and production companies who process voice data. Mediartis allows them to provide tools to their artists so they can exercise their legal rights, ensure voice data security and full transparency of the data they are handling. We have been actively advocating for voice data security and industry best practices that ensure ethic and legally compliance processing of voice data since our launch in 2019. The architecture of our platform ensures that no physical files are shared in order to protect misuse of voice files, that voice data is encrypted during import and while circulating on the network, that access to voice data is secured with multi-level user permissions, and that actors have full transparency of their data being processed, why it is being processed, for how long it is being processed. Política sobre el Uso de la Voz de Locutores para el Entrenamiento de Sistemas de Inteligencia Artificial en Maikolofoni Estudio (México) 1. Objeto y Alcance: Esta política establece los lineamientos y principios que rigen la adquisición, uso y gestión de la voz de locutores (en adelante, la “Voz”) para el entrenamiento de sistemas de inteligencia artificial (en adelante, los “Sistemas de IA”) dentro de Maikolofoni Estudio en México. Esta política aplica a todos los empleados, colaboradores, contratistas y terceros que trabajen con Maikolofoni Estudio y participen en el desarrollo, implementación o uso de Sistemas de IA que requieran el uso de la Voz. 2. Principios Fundamentales de Maikolofoni Estudio: Respeto y Valoración del Talento Vocal: Maikolofoni Estudio reconoce y valora el talento y la singularidad de la voz de cada locutor. El uso de su Voz para el entrenamiento de Sistemas de IA se realizará con el máximo respeto por sus derechos y su contribución artística. Consentimiento Informado y Transparencia Total: El uso de la Voz requerirá el consentimiento explícito, informado y específico del locutor, proporcionado con total transparencia sobre los fines, la duración, las posibles modificaciones y la compensación. Control y Derechos Primordiales del Locutor: Maikolofoni Estudio reconoce y respetará los derechos morales y patrimoniales del locutor sobre su Voz. Se establecerán mecanismos claros para que el locutor pueda conocer el uso de su Voz, solicitar correcciones o eliminaciones (en los términos acordados) y revocar su consentimiento. Seguridad Robusta y Confidencialidad Garantizada: Se implementarán las más altas medidas de seguridad para proteger la Voz contra accesos no autorizados, uso indebido, alteraciones o divulgaciones no consentidas, asegurando la confidencialidad en todo momento. Compensación Justa y Acorde al Mercado: Maikolofoni Estudio se compromete a ofrecer una compensación justa y acorde a las prácticas del mercado mexicano por la licencia y el uso de la Voz para el entrenamiento de Sistemas de IA, reconociendo el valor de su trabajo. Trazabilidad y Reconocimiento de la Fuente: Se mantendrá un registro detallado de la fuente de cada Voz utilizada, incluyendo la identificación del locutor y los términos del acuerdo. Cuando sea apropiado y con el consentimiento del locutor, se buscará reconocer su contribución. 3. Adquisición y Consentimiento de la Voz por Maikolofoni Estudio: Acuerdos Contractuales Claros y Justos: La adquisición de la Voz se realizará mediante contratos escritos y transparentes con los locutores, especificando claramente: La finalidad precisa del uso de la Voz para el entrenamiento de Sistemas de IA. La duración del licenciamiento y las condiciones de renovación (si aplica). El territorio de uso (si aplica). Las posibilidades y límites de modificación o adaptación de la Voz. La estructura y el monto de la compensación. Las cláusulas de confidencialidad y las medidas de seguridad implementadas por Maikolofoni Estudio. La titularidad de los derechos de propiedad intelectual derivados del uso de la Voz (si aplica) y su alcance. El procedimiento claro para la revocación del consentimiento por parte del locutor. Proceso de Consentimiento Informado Detallado: Maikolofoni Estudio se asegurará de que el locutor otorgue su consentimiento de manera libre, específica, informada e inequívoca, proporcionando información completa y comprensible sobre: La identidad de Maikolofoni Estudio como responsable del tratamiento de sus datos de voz. Los fines específicos y el alcance del uso de su Voz en el entrenamiento de Sistemas de IA. Los posibles riesgos y beneficios asociados al uso de su Voz. Los derechos que le asisten en relación con sus datos de voz bajo la legislación mexicana (acceso, rectificación, cancelación, oposición, portabilidad, limitación del tratamiento). La posibilidad de revocar su consentimiento en cualquier momento y las consecuencias de dicha revocación. 4. Control y Seguridad de la Voz en Maikolofoni Estudio: Implementación de Medidas de Seguridad Avanzadas: Maikolofoni Estudio implementará y mantendrá medidas técnicas y organizativas de vanguardia para garantizar la seguridad y confidencialidad de los datos de voz, incluyendo: El cifrado robusto de los datos de voz durante el almacenamiento y la transmisión. Un estricto control de acceso a los datos de voz mediante sistemas de autenticación y autorización multi-factor. La implementación de firewalls de última generación y sistemas avanzados de detección de intrusiones. La realización de auditorías de seguridad internas y externas de forma regular. La capacitación continua del personal sobre las políticas y los procedimientos de seguridad de la información. Uso Estrictamente Limitado: El uso de la Voz se limitará exclusivamente a los fines especificados en el consentimiento y en el contrato con el locutor. Cualquier uso para fines distintos requerirá un nuevo consentimiento explícito. Responsabilidad y Transparencia ante Brechas de Seguridad: En caso de una brecha de seguridad que comprometa la confidencialidad o integridad de la Voz, Maikolofoni Estudio actuará con diligencia para implementar los protocolos de notificación y respuesta establecidos por la legislación mexicana aplicable en materia de protección de datos personales, informando al locutor afectado de manera oportuna y transparente. 5. Compensación Justa y Equitativa por Maikolofoni Estudio: Negociación Transparente y Acuerdos Justos: La compensación al locutor se establecerá mediante una negociación transparente y un acuerdo contractual justo y equitativo, considerando las tarifas estándar del mercado mexicano para el uso de voz en proyectos de inteligencia artificial, la experiencia del locutor y el valor que aporta su Voz al entrenamiento del Sistema de IA. Diversidad de Modelos de Compensación: Maikolofoni Estudio podrá ofrecer diversos modelos de compensación, adaptados a las necesidades del proyecto y al acuerdo con el locutor, tales como: Un pago único por la licencia de uso por un periodo específico. Pagos periódicos basados en la duración del uso o la cantidad de datos utilizados. Regalías o pagos variables basados en el éxito comercial o el rendimiento del Sistema de IA que utiliza la Voz. Una combinación de estos modelos. Claridad en los Términos de Compensación: Los términos de la compensación se detallarán de manera clara y comprensible en el contrato, especificando los criterios de cálculo, las formas de pago y los plazos correspondientes. 6. Reconocimiento de la Fuente de la Voz por Maikolofoni Estudio: Registro Detallado y Trazabilidad Completa: Maikolofoni Estudio mantendrá un registro exhaustivo y actualizado de la fuente de cada Voz utilizada para el entrenamiento de los Sistemas de IA, incluyendo la identificación completa del locutor y la documentación del consentimiento y el contrato firmado. Atribución Oportuna y Consentida: En los casos en que se considere relevante para el proyecto y se cuente con el consentimiento explícito del locutor, Maikolofoni Estudio realizará una atribución adecuada y visible de la fuente de la Voz en la documentación del Sistema de IA, en los créditos o en la interfaz de usuario. Transparencia en el Uso de Voces Sintéticas Basadas en Locutores: Cuando un Sistema de IA genere una voz sintética basada en la de un locutor específico, Maikolofoni Estudio informará claramente a los usuarios cuando sea relevante y siempre y cuando se cuente con el consentimiento explícito del locutor para dicha divulgación. 7. Cumplimiento Normativo en México por Maikolofoni Estudio: Maikolofoni Estudio se compromete a cumplir estrictamente con la legislación mexicana aplicable en materia de protección de datos personales (Ley Federal de Protección de Datos Personales en Posesión de los Particulares y su Reglamento),1 derechos de autor y propiedad intelectual (Ley Federal del Derecho de Autor), y cualquier otra normativa que pueda ser relevante para el uso de la voz de locutores en el entrenamiento de inteligencia artificial. Esta política será revisada y actualizada periódicamente por asesores legales especializados para asegurar su continua conformidad con la legislación vigente y las mejores prácticas en la industria de la inteligencia artificial en México. 8. Responsabilidades dentro de Maikolofoni Estudio: El Departamento Legal de Maikolofoni Estudio/Responsable Designado de Protección de Datos/Equipo de Desarrollo de IA será el responsable principal de la implementación, supervisión y el cumplimiento de esta política. Todos los empleados, colaboradores y contratistas que trabajen con Maikolofoni Estudio y utilicen la Voz para el entrenamiento de Sistemas de IA son responsables de conocer y cumplir con esta política. 9. Consecuencias del Incumplimiento en Maikolofoni Estudio: El incumplimiento de esta política por parte de empleados, colaboradores o contratistas de Maikolofoni Estudio podrá dar lugar a las sanciones correspondientes, de acuerdo con las políticas internas del estudio y la legislación mexicana aplicable. 10. Revisión y Actualización Continua por Maikolofoni Estudio: Esta política será revisada y actualizada al menos anualmente o cuando sea necesario para reflejar cambios en la legislación mexicana, los avances tecnológicos en inteligencia artificial y las mejores prácticas de la industria. Maikolofoni Estudio se compromete a mantener esta política actualizada y accesible para todos los involucrados. Consideraciones Adicionales Específicas para Maikolofoni Estudio en México: Énfasis en los Derechos Morales: Maikolofoni Estudio pondrá especial énfasis en el respeto de los derechos morales de los locutores, tal como se definen en la Ley Federal del Derecho de Autor, asegurando que cualquier modificación o alteración de su interpretación vocal se realice con su consentimiento y respetando su integridad artística. Transparencia en la Relación Laboral (si aplica): En los casos en que la relación con el locutor sea de tipo laboral, Maikolofoni Estudio se asegurará de cumplir con todas las leyes laborales mexicanas aplicables, garantizando los derechos y las obligaciones tanto del estudio como del locutor. Tratamiento de Datos Sensibles con Diligencia: Maikolofoni Estudio reconoce que la voz puede ser considerada un dato personal sensible y, por lo tanto, su tratamiento se realizará con la máxima diligencia y cumpliendo estrictamente con los requisitos establecidos en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares y su Reglamento.

The “Permitted Uses” are Pozotron’s business use, including use of Data for: (i) providing the Services hereunder, (ii) research, development, trouble-shooting/de bugging and testing of the Services, and (iii) improvement of the functionality of the Services. For clarity, improvement of the functionality of the Services includes making anonymized electronic copies of sentences from the Transcript (“Sentences”) and copies of the corresponding segments in the recordings in which those Sentences are recorded (“Audio Segments”), for the purpose of electronically comparing the Sentences and the Audio Segments in order to improve the accuracy of the Service’s ability to compare voices to text.

 

Company shall not use Customer’s Data for the purposes of mapping/replicating the performance elements of human narration and creating an artificial likeness of a voice provided by Customer as part of the Services hereunder, without the prior consent of the Customer and the person whose voice is used in the Recording (the “Consenting Narrator”).

Sublight Games does not submit data for synthetic voice models, digital clones, replicas, or AI or machine learning. Our contractors are welcome to consent to their likeness being utilized in this way elsewhere if so desired.

Sublight Games standard contracts all include the latest NAVA AI rider.

Sublight Games specifically agrees not to sell or transfer ownership of all or part of any of the recordings, performance, arts, assets, or other Works of the Contractor to any third party without the Contractor’s prior knowledge and explicit written consent.

Sublight Games negotiates fair non-union and SAG-E rates which may be revisited at any time at the request of the Contractor.

Security

Sublight Games takes all precautions to keep data secure via end-to-end and at-rest encryption. Production accounts must use two-factor authentication.

Sublight Games does not train, create, or utilize AI or digital replica voices.

TOS

The Tales Network often holds casting calls, and produces audio dramas, fiction podcasts, and TTRPG shows. We do not condone the usage of AI/Machine Learning. We will never sell Voice Actor audio files to a third party, nor will use synthetic or doubled voices.

Absolutely no consent is given for any third parties to use any Tales of the Forgotten Fiction Network productions, including but not limited to artwork and sound production, to train their AI/Machine Learning Models.

Whenever rate quotes are needed, The Voicecaster uses industry standard rates from SAG-AFTRA, GVAA, or other industry wide accepted rate guides applicable to the location or country you are working in.

Security

The Voicecaster will use good faith efforts to prevent any files of recordings or performances stored in digital format containing Talent’s voice or likeness from unauthorized access by third parties, and if such files are stored in “the cloud” we utilize services that offer safeguards through encryption or other “up-to date” technological means from unauthorized third party access.

Recordings may not be used to develop an artificial voice model, now or in the future, on any platform. Possessing voiceover audio via auditions or audio provided as part of a paid for project does not entitle any users of the platform to reproduce, mimic, or otherwise replicate the voice of the individual who created it. Users are expressly forbidden from doing so, either directly or indirectly, without prior written permission from the voice artist. Such consent must specify the type of AI Technology intended for use, such as AI Voice Cloning or AI Voice Model Training. No AI Technology, including AI Voice Cloning or AI Voice Model Training, may be employed unless all parties have provided written consent outlining the project’s scope and the specific AI Technology to be used. Any users of the platform agree to indemnify VoicesUS against all claims, damages, liabilities, settlements, legal fees, and expenses arising from any violation of this provision.

VOPlanet, LLC does not work with, have agreements with or condone the use of voiceover created by artificial intelligence (AI) in any manner. VOPlanet, LLC will delete jobs posted by AI companies soliciting use of voice work for digital cloning purposes. VOPlanet, LLC does not allow the use of artificial intelligence voiceover creators to create accounts, buy memberships or audition for VOPlanet, LLC projects. VOPlanet, LLC does not accept offers for the use of our voice files for use in creation of digital voice clones or AI voices. VOPlanet, LLC voiceover talent are freelance contractors and are free to negotiate fair compensation for use of their voice for digital cloning as they see fit if those transactions are conducted off our Site, directly between the voice buyer and the voiceover talent.
